Welcome to Eternalpaws.pet! These Terms of Use (“Terms”) govern your access to and use of the website Eternalpaws.pet, including all pages, features, and services offered by Eternal Paws, LLC (“we,” “us,” or “our”) (collectively, the “Site”).

1. Use of the Site
Eternalpaws.pet is an online platform that allows users to purchase pet-related products and create, share, and view digital memorials for beloved pets.

To access certain features (such as creating memorials or making purchases), you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. 3. User-Generated Content
When you create a pet memorial or upload any content (photos, videos, stories, tributes, comments, or other materials) to the Site (“User Content”), you retain ownership of your content. However, by posting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and create derivative works from your User Content in connection with operating, promoting, marketing, and improving the Site and our services.
You are solely responsible for the User Content you post. You represent and warrant that:
You own or have the necessary rights and permissions to post the User Content.
Your User Content does not violate any third-party rights (including copyright, privacy, or publicity rights).
Your User Content is respectful and does not contain offensive, abusive, or illegal material.
We reserve the right (but have no obligation) to review, edit, or remove any User Content that violates these Terms.
4. Purchases and Payments
All purchases made through the Site are subject to our shipping and return policies (available on the Site). Prices are subject to change without notice. We use third-party payment processors to handle transactions. By making a purchase, you agree to pay all charges associated with your order, including taxes and shipping fees.

The Site and all services are provided “as is” and “as available” without any warranties of any kind, either express or implied.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. We are not responsible for any User Content posted by others.
To the fullest extent permitted by law, Eternal Paws, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or emotional distress, arising out of or related to your use of the Site, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless Eternal Paws, LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of your use of the Site, your User Content, or your violation of these Terms.
9. Termination
We may terminate or suspend your access to the Site at any time, without notice, for any reason, including breach of these Terms. Upon termination, your right to use the Site will cease immediately. Memorial content may remain on the Site even after your account is terminated, in accordance with our Privacy Policy and Copyright Policy.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Los Angeles County, California.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Site with a new effective date. Your continued use of the Site after such changes constitutes your acceptance of the revised Terms.
